These General Terms of Use, Terms of Sale, and Privacy Policy regulate the use of www.unionsuiza.com (hereinafter unionsuiza.com), owned by Unión Suiza, S.A. (hereinafter UNIÓN SUIZA), with Tax ID A08053167 and registered office at Vía Augusta, 1, Barcelona 08006.
Through its website www.unionsuiza.com, UNIÓN SUIZA provides information about its products and offers the possibility of purchasing them. Due to the content and purpose of unionsuiza.com, individuals who wish to benefit from its services must qualify as a "Client," which is acquired by completing the registration form and following the steps that UNIÓN SUIZA subsequently communicates via email. The status of Client implies adherence to the Terms of Use of the version published at the time the Website is accessed.
In any case, there are pages on unionsuiza.com accessible to natural or legal persons who do not register or initiate a product purchase (hereinafter, "Users"). In this regard, Users who access these parts of unionsuiza.com agree to be subject to the terms and conditions set forth in these General Conditions, to the extent that they may be applicable. PRODUCT INFORMATION
The descriptions of the products displayed on the Website are based on information provided by the company. However, the information provided for each product, as well as the photographs or videos relating to them and the commercial names, brands, or distinctive signs of any kind contained on the UNIÓN SUIZA website, are displayed on www.unionsuiza.com as a guide.
PRICES
All product prices indicated on the website include VAT and any other applicable taxes. However, these prices do not include shipping costs, which are detailed separately and must be accepted by the Client.
AVAILABILITY
UNIÓN SUIZA informs the Client that the number of available units is kept updated with stock in the warehouse and availability from our suppliers. Under no circumstances will UNIÓN SUIZA intentionally sell more units than it has available.
UNIÓN SUIZA will do everything possible to satisfy all its Clients' demand for products. However, occasionally, and due to causes that are difficult for UNIÓN SUIZA to control, such as human errors or incidents in computer systems, it is possible that the total number of units to satisfy Client orders may differ from the stock quantity.
In the event that the product is not available after the order has been placed, the Client will be informed by email of the total or partial cancellation of the order. Partial cancellation of the order due to lack of availability does not entitle the Client to cancel the entire order. If, as a result of this cancellation, the Client wishes to return the delivered product, they must follow the provisions of the Return section.
PAYMENT
The Client undertakes to pay at the time of placing the order. The purchase ticket or proof corresponding to the purchase order will be available and can be viewed on www.unionsuiza.com in the "Your account," "My Orders" section.
The Client must pay the amount corresponding to their order by credit or debit card (Visa, Mastercard, Visa Electron, and/or other similar cards), bank transfer, or deposit into an account at a LaCaixa branch. The card used for payment must have a Spanish bank or savings bank as its issuing financial institution. Card payment is made through the Servired payment gateway with its security protocols.
The Client must notify UNIÓN SUIZA of any undue or fraudulent charge to the card used for purchases, by email or telephone, as soon as possible so that UNIÓN SUIZA can take appropriate action.
SECURITY
UNIÓN SUIZA has the highest commercially available security measures in the sector. Furthermore, the payment process operates on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection so that information is transmitted encrypted using 128-bit algorithms, ensuring that it is only intelligible to the Client's computer and unionsuiza.com's. In this way, using the SSL protocol guarantees:
- That the Client is communicating their data to the UNIÓN SUIZA server center and not to any other that might attempt to impersonate it.

That between the Client and the UNIÓN SUIZA server center, data is transmitted encrypted, preventing its possible reading or manipulation by third parties.
ORDER PLACEMENT
Once the order has been placed, i.e., with the acceptance of the Terms of Use and the confirmation of the purchase process, UNIÓN SUIZA will always send an email to the CLIENT confirming the details of the purchase made.
ORDER CANCELLATION
UNIÓN SUIZA will accept order cancellations if requested before the order is shipped. To cancel, please request it using the "Contact us" form or by sending an email to info@unionsuiza.com.
DELIVERY TIMES, LOCATION, AND LOSSES
I. Product Delivery: UNIÓN SUIZA undertakes to deliver the product in perfect condition to the address specified by the Client in the order form, which must in all cases be within the Territory. To optimize delivery, we kindly ask the Client to provide an address where the order can be delivered during regular business hours.
UNIÓN SUIZA shall not be liable for errors caused in delivery when the delivery address entered by the Client in the order form does not correspond to reality or has been omitted.
UNIÓN SUIZA informs the Client that a single order may be divided into several deliveries.
II. Delivery Time: Shipments will be made through a courier company. The order placed by you will be delivered within a maximum of 10 business days from the confirmation of your order. Although UNIÓN SUIZA's usual delivery time is between 3 and 6 days from the completion of the order.
These deadlines are averages and therefore an estimate. Therefore, they may vary due to logistical reasons or force majeure. In cases of delivery delays, UNIÓN SUIZA will inform its clients as soon as it becomes aware of them.
Each delivery is considered to have been made from the moment the transport company Unión Suiza makes the product available to the Client, which is materialized through the control system used by the transport company.
In the event of delivery delays attributable to UNIÓN SUIZA, the Client may cancel their order in accordance with the procedure described in Section "11. Returns". Delays in delivery shall not include cases where the order has been made available to the Client by the transport company within the agreed period and could not be delivered due to a reason attributable to the Client.
Once the order leaves our warehouses, an email will be sent to you notifying you that your order has been accepted and is being shipped.
For security reasons, UNIÓN SUIZA will not send any order to PO boxes or military bases, nor will it accept any order where it is not possible to identify the recipient of the order and their address.
III. Delivery Details, Undelivered Items and Loss If the Client is absent at the time of delivery, the carrier will leave a proof of delivery indicating how to arrange a new delivery. UNIÓN SUIZA contracts, as part of its courier delivery service, a series of tracking actions aimed at ensuring delivery.
If after 7 business days from the dispatch of the order, delivery has not been arranged, the Client must contact UNIÓN SUIZA.
If the Client does not proceed as such, after 10 business days from the dispatch of the order, it will be returned to our warehouses and the Client must bear the shipping and return costs of the merchandise, as well as any associated management fees.
If the reason for not being able to deliver is the loss of the package, our carrier will initiate an investigation. In these cases, our carriers' response times usually range from one to three weeks.
IV. Due Diligence in Delivery The Client must check the good condition of the package in the presence of the carrier who, on behalf of UNIÓN SUIZA, delivers the requested product, indicating on the delivery note any anomaly they may detect in the packaging. If, subsequently, after reviewing the product, the Client detects any incident such as a blow, breakage, signs of having been opened, or any damage caused to it by the shipment, they undertake to notify UNIÓN SUIZA via email as soon as possible, preferably within the following 24 hours and a maximum of 7 natural days from delivery.
RETURN
I. Return procedure: All products purchased at UNIÓN SUIZA may be returned and refunded, provided that the Client notifies UNIÓN SUIZA of their intention to return the purchased product(s) within a maximum period of 15 business days from the delivery date and that the other conditions established in this section are met.
UNIÓN SUIZA will only accept returns that meet the following requirements:

The product must be in the same condition as it was delivered and must retain its original packaging and labeling.
- Shipping must be done using the same box in which it was received to protect the product.
In the event that it cannot be done with the box it was delivered with, the Client must return it in a protective box to ensure that the product arrives at the UNIÓN SUIZA warehouse with the best possible guarantees.
- A copy of the delivery note must be included inside the package, also marking the returned products and the reason for the return.
In order to facilitate the return process for Clients and to allow for proper tracking, UNIÓN SUIZA establishes the procedure set by UNIÓN SUIZA as the sole return procedure. If the reason for the return is attributable to UNIÓN SUIZA (the product is defective, it is not what you ordered, etc.), the amount of the return will be refunded.
If the reason is otherwise (the products were delivered correctly but are not to your liking), the cost of return shipping will be borne by the customer.
To proceed with a return, the following steps must be followed:

Notify within 15 calendar days of receipt that the product is to be returned. This notification can be made via email to info@unionsuiza.com or through the customer service form.
- UNIÓN SUIZA will inform the customer of the address to which the product should be sent.

The customer must send it through a courier company of their choice. The return shipping must be paid by the customer.
- Inform Unión Suiza of the courier used, date, and time of the return.
Refunds to the CLIENT: The return of products will result in a refund equal to the cost of the returned products minus the cost of the return service.
Only in the event that the delivered product is defective or incorrect, UNIÓN SUIZA will also reimburse the Client for the corresponding shipping costs.
Returns and partial cancellations will result in partial refunds.
UNIÓN SUIZA will process the return order using the same payment system that was used for the original payment within 3 days of the returned order's arrival confirmation at the warehouse. The application of the refund to the Client's account or card will depend on the card and the issuing entity. The application period will be up to 7 days for debit cards and up to 30 days for credit cards.
WARRANTY OF PURCHASED PRODUCTS
UNIÓN SUIZA acts as a distributor that guarantees that the products offered for sale on www.unionsuiza.com do not have defects or hidden flaws that could make them dangerous or unsuitable for normal use.
The contractual warranty offered is that customarily granted by the manufacturer. Once the Client has received the product, they will have the instructions provided by the manufacturer in its box, sufficient for the correct use and installation of the product and all information about the warranty. No Client may request a broader warranty than that indicated therein.
UNIÓN SUIZA will not be obliged to collect the damaged product and the Client must contact the Manufacturer's After-Sales Service. In this regard, UNIÓN SUIZA will take action to provide Clients who request it with the contact details of said service and will provide sufficient information for the presentation of relevant claims.
The warranty will be void in the event of defects or deterioration caused by external factors, accidents, especially electrical accidents, wear and tear, installation and use not in accordance with the Manufacturer's instructions. Products modified or repaired by the Client or any other person not authorized by the Manufacturer are excluded from the warranty. The warranty will not apply to apparent defects and conformity defects of the product, for which any claim must be made by the Client in question within 7 days following the delivery of the products. The warranty will not cover products damaged by improper use.
INTELLECTUAL AND INDUSTRIAL PROPERTY
UNIÓN SUIZA holds all rights to the content, design, and source code of this Website and, in particular, by way of illustration but not limitation, to the photographs, images, texts, logos, designs, brands, trade names, and data included on the Web.
Clients and Users are warned that such rights are protected by current Spanish and international intellectual and industrial property legislation. Likewise, and without prejudice to the foregoing, the content of this Website also qualifies as a computer program, and therefore, all current Spanish and European community regulations on the matter also apply.
Total or partial reproduction of this Website, or any of its contents, is expressly prohibited without the express written permission of UNIÓN SUIZA.
Likewise, copying, reproduction, adaptation, modification, distribution, commercialization, public communication and/or any other action that entails an infringement of current Spanish and/or international regulations regarding intellectual and/or industrial property, as well as the use of the contents of the Website without the prior express written authorization of UNIÓN SUIZA, is totally prohibited.

- Errors or delays in accessing the Website by the Client when entering their data in the order form, slowness or impossibility of receiving order confirmation by the recipients, or any anomaly that may arise when these incidents are due to problems on the Internet network, fortuitous events or force majeure, and any other unforeseeable contingency beyond the good faith of UNIÓN SUIZA.
- Failures or incidents that may occur in communications, deletion or incomplete transmissions, so it is not guaranteed that the services of unionsuiza.com will be constantly operative.
- Errors or damages caused to the website by inefficient and bad faith use of the service by the Client.
- Non-operability or problems with the email address provided by the Client for sending the order confirmation.
- In any case, UNIÓN SUIZA undertakes to solve any problems that may arise and to offer all necessary support to the Client to reach a quick and satisfactory solution to the incident.
- Likewise, UNIÓN SUIZA has the right to carry out promotional campaigns for defined time intervals to promote the registration of new members in its service. UNIÓN SUIZA reserves the right to modify the conditions of application of the promotions, extend them by duly communicating it, or proceed to the exclusion of any of the participants in the promotion if any anomaly, abuse or unethical behavior in their participation is detected.
NULLITY
In the event that any clause of these Terms of Use is declared null, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the very purpose of these Terms of Use. UNIÓN SUIZA may not exercise some of the rights and powers conferred in this document, which will in no case imply a waiver of them unless expressly acknowledged by UNIÓN SUIZA or prescription of the action that corresponds in each case.
MODIFICATION OF THE TERMS OF USE
UNIÓN SUIZA reserves the right to modify, at any time, the presentation and configuration of unionsuiza.com, as well as these General Conditions. Therefore, UNIÓN SUIZA recommends the Client to read them carefully each time they access the Website. APPLICABLE LAW AND ARBITRATION
These Terms of Use are governed by the applicable Spanish law on the matter. To resolve any dispute or conflict arising from these Terms of Use, the parties submit to the jurisdiction of the courts of the city of Barcelona, unless the law imposes another jurisdiction.
